These rules establish the order of maintaining and storage of service records, and also the order of production of forms of the service record and providing employers with them.

The service record is the main document on the labor activity and the working life of the worker. The employer except for employers - physical persons, not being individual entrepreneurs keeps service records on each worker who worked for it over five days if work at this employer is for the worker the main.

The employer - physical person, being the individual entrepreneur, is obliged to keep service records on each worker in the order established by the Labor code of the Russian Federation and other regulatory legal acts of the Russian Federation. The employer - physical person, not being the individual entrepreneur, has no right to make entries in service records of workers and to make out service records to the workers employed for the first time.

Data on the worker, the work performed by it, transfer into other permanent job and about dismissal of the worker, and also the basis of the termination of the employment contract and data on rewarding for progress in work are brought in the service record.

Data on collectings are not brought in the service record, except as specified, when authority punishment is dismissal. Service records are kept in the state language of the Russian Federation, and in the territory of the republic within the Russian Federation which established the state language, registration of service records can be conducted along with the state language of the Russian Federation and in the state language of this republic.

The employer is obliged according to the written application of the worker no later than three working days from the date of its giving to issue to the worker the copy of the service record or the statement certified in accordance with the established procedure from the service record.

At recovery in accordance with the established procedure of the continuous working life in the service record of the worker record about recovery of the continuous working life with indication of the relevant document is made on the last work location.

Modification and corrections in the service record. The employer is obliged to give in this case to the worker at its address necessary assistance. If the organization which made the wrong or inexact record, is reorganized, correction is made by her legal successor, and in case of liquidation of the organization - the employer on new work location on the basis of the relevant document.

If the wrong or inexact employment records are made by the employer - physical person, being the individual entrepreneur, and its activity is stopped in accordance with the established procedure, correction is made by the employer on new work location on the basis of the relevant document.

The corrected data shall correspond completely to the document on the basis of which they were corrected. In case of loss of such document or discrepancy to its actually performed work correction of data on work is made on the basis of other documents confirming performance of works, which are not specified in the service record.

Testimony cannot form the basis for correction of the records made earlier, except for records concerning which there is the judgment, and also cases, stipulated in Item 34 these rules. In the sections of the service record containing data on work or data on rewarding, deletion of inexact or wrong records is not allowed.

Change of records is made by recognition their invalid and introduction of the correct records. In the same order change of record about dismissal of the worker transfer into other permanent job in case of recognition of dismissal transfer is made by the illegal. The person which lost the service record is obliged to declare immediately it to the employer on the last work location.

The employer issues to the worker the duplicate of the service record no later than 15 days from the date of submission of the statement by the worker.

The employer on the basis of the act of the commission issues to the worker the duplicate of the service record.

If documents did not remain, the length of service including established on the basis of testimony can be confirmed judicially. Transfer of the service record by mail to the address specified by the worker is allowed only from its consent. From the date of the direction of the specified notification the employer is exempted from liability for the delay of issue to the worker of the service record.

In case of death of the worker the service record after entering into it of the corresponding record about the termination of the employment contract is handed out to one of his relatives on receipt or sent by mail according to the written application of one of relatives.

The insert in the service record If in the service record all pages of one of sections are completed, in the service record the insert which is made out and conducted by the employer in the same order, as the service record is sewed.

The insert without service record is invalid. At issue of each insert in the service record the stamp with the text is put "the insert Is issued" and the series and number of the insert is specified.

At receipt of the service record in connection with dismissal the worker undersigns for the personal card and for the book of accounting of the movement of service records and inserts in them. The account book on accounting of forms of the service record and the insert in it and the book of accounting of the movement of service records and inserts shall be numbered, strung together, certified of them by the signature of the head of the organization, and also are sealed sealing wax or sealed up.

Forms of the service record and the insert in it are stored in the organization as documents of the strict accounting and issued to the person responsible for maintaining service records, according to its request. Upon termination of every month the person responsible for maintaining service records is obliged to submit in accounts department of the organization the report on availability of forms of the service record and the insert in it and about the amounts received for the issued service records and inserts in them with appendix of the materials receipt ticket of cash desk of the organization.

The forms of the service record and the insert damaged when filling in it are liable to destruction with drawing up the relevant act. The service records and duplicates of service records which are not received by workers at dismissal or in case of death of the worker his nearest relations are stored poste restante at the employer in the organization or at physical person, being the individual entrepreneur according to the requirements to their storage established by the legislation of the Russian Federation on archiving.

The employer is obliged to have constantly available necessary number of forms of the service record and inserts in it. Responsibility for observance of the order of maintaining service records Responsibility for the organization of work on maintaining, storage, accounting and issue of service records and inserts in them is assigned to the employer.

Responsibility for maintaining, storage, accounting and issue of service records bears specially authorized person designated by the order order of the employer. Officials bear the responsibility established by the legislation of the Russian Federation for violation of the order of maintaining, accounting, storage and issue of service records established by these rules.

Production of forms of the service record and providing employers with them Production of forms of the service record and the insert in it and providing employers with them on the paid basis are performed in the order approved by the Ministry of Finance of the Russian Federation.
